Scalise: Health Care Bill Unconstitutional, Calls on La. AG to Challenge Individual Mandate

March 22, 2010

Washington, DC -- On Saturday, Congressman Steve Scalise introduced an amendment to H.R. 3590, the government takeover of health care, that would have repealed the unconstitutional individual mandate that requires all American’s to buy government approved health insurance. Scalise is calling on Louisiana Attorney General Buddy Caldwell to challenge the constitutionality of the individual mandate in court.

“Congress does not have the authority to force all Americans to buy government-approved health insurance,” Scalise said. “I am calling on our state’s Attorney General to protect Louisiana residents by challenging the unconstitutional individual insurance mandates.”

Last week Scalise presented an amendment to President Obama’s health care bill to repeal the unconstitutional individual insurance mandate, along with the $17 billion in the taxes that it imposes. He also presented legal summaries from constitutional scholars at the Heritage Foundation.
